Privacy Policy

  1. Purpose and Scope of this Privacy Policy.
    1. This Privacy Policy describes how Complex Media, Inc., its parents, and its affiliates (collectively, “Complex”) collects, uses, and discloses Personally Identifiable Information that Complex collects about you when you use the application to which this policy is linked (the “Complex App”). Terms used but not defined in this Privacy Policy have the meanings given them in our Terms of Use (located at www.complexnetworks.com/pages/terms-of-use). For the purposes of this Privacy Policy, “Personally Identifiable Information” is information that we can use to identify or contact you as an individual, and includes your name, email address, address, telephone number, and other information that we associate with such information. By submitting Personally Identifiable Information through the Complex App, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your Personally Identifiable Information in accordance with this Privacy Policy.
    2. Except as specified herein, this Privacy Policy does not apply to information you may provide to us offline.
  2. Collection of Information
    1. Information You Provide. Complex collects Personally Identifiable Information that you voluntarily provide. For instance, when you send us an email or provide feedback through the Complex App, you may be asked to provide information such as your email address and name, and we will collect such information as well as the other information you provide us.
    2. Information We Collect About You
      1. We use Google Analytics to collect certain aggregate information, such as view counts per video, about how users use the Complex App. Aggregate information does not identify individual users. We may share this aggregate information with our prospective and actual business partners, advertisers and other third parties for any business purpose. In addition, Google may have access to this aggregate information. You may read Google’s Privacy Policy (including any opt-out mechanisms that Google offers regarding information collected via Google Analytics) here and here.
      2. Cookies. We may receive data from Google Analytics that is collected using cookies and similar technologies when you are using the Complex App. A cookie is a small file containing a string of characters that is sent to your device when you use an app (or visit a website). When you use the app (or visit the website) a second time, the cookie allows the app or website to recognize your device (or browser). Some app or website features may not function properly without cookies. We use data collected by Google Analytics cookies to understand how people use the Complex App and to improve the content and offerings in the Complex App. We may also use this data to track usage patterns on the Complex App. If you do not want cookies, do not download or use the Complex App.
      3. Device Identifiers. We may receive data from Google Analytics that is collected using unique identifiers assigned by Google Analytics to the device upon which you have downloaded and are using the Complex App. You can limit the use of these device identifiers by accessing your device settings to limit their use or to reset your device identifier.
      4. GIFs. We may receive data from Google Analytics that is collected using “clear GIFs” (aka “web beacons” or “pixel tags”) or similar technologies. We may also use clear GIFs in our communications with you to enable us to know whether you have received a message. A clear GIF is typically a one-pixel, transparent image (although it can be a visible image as well), located on a web page or in an email or other type of message, which is retrieved from a remote site on the Internet, enabling the verification of an individual’s viewing or receipt of a web page or message. A clear GIF may enable us to relate your viewing or receipt of a web page or message to other information about you, including your Personally Identifiable Information.
      5. HTTP Referrer. We may receive data from Google Analytics that is collected using an HTTP referrer, which transmits information from a web browser to a destination webpage. HTTP referrers may contain information about the browser and system of the device that you are using to access the Complex App.
      6. IP Address. Your Internet Protocol (“IP”) address is usually associated with the device from which you enter the Internet, like your Internet Service Provider, your company or your university. IP addresses are usually assigned based on the geographic location of the device you use, and can be used to identify the geographic location of the device that you are using to access the Complex App. The Complex App may collect your IP address. We may use your IP address to help diagnose problems with our servers, gather broad demographic information, and administer the Complex App. We may also link this information with your Personally Identifiable Information when we feel that it is necessary to enforce compliance with our rules and policies or Terms of Use or to protect the Complex App, customers or others. Google may also collect your IP address via Google Analytics and use your IP address as further described in the Google Analytics Privacy Policy.
      7. Third Parties. We may obtain information from third parties that collect consumer information such as demographic and interest data, and may use that information and combine it with other information we have about you to help us predict your preferences and provide content that meets your interests. These third parties have their own privacy policies that govern our use of information we receive from them. Any use of their information by us will be in compliance with their privacy policy and with this Privacy Policy.
  3. Use of Information.
    1. Complex uses information we collect from you to provide the services and content you access through the Complex App, to improve our services and content offerings in the Complex App, and to diagnose and fix service issues with the Complex App.
    2. We may combine and use any and all information we collect on you either online or otherwise, including from third parties, for marketing purposes.
    3. We may create aggregated, anonymized or de-identified information from Personally Identifiable Information and may use and share such aggregated information for any purpose.
  4. 4. Disclosure of Your Information
    1. By using the Complex App, you authorize us to share or disclose Personally Identifiable Information about you to other companies or individuals in the following situations:
      1. We may use third party service providers to provide products, services or functions on our behalf. Any service provider we use is required to maintain the confidentiality of your Personally Identifiable Information and not to use your Personally Identifiable Information for any reason except to carry out the purpose(s) for which we provide it to them.
      2. With Verizon and its affiliates including AOL. The Verizon privacy policy applies for Verizon and AOL use of this information.
      3. With any Affiliate of Complex.
      4. In accordance with your indicated preferences (e.g., you indicated you wanted to receive promotional materials directly from a third party partner).
      5. You have furnished us Personally Identifiable Information with the intent that it be forwarded to a third party for use in connection with a specified service you are electing to participate in (examples include e-commerce partners, services to help old friends locate you online, etc.).
      6. We need to protect our legal rights (for example, if we are trying to collect money you owe us); we must comply with applicable laws, regulations, or legal or regulatory process, or comply with subpoenas or warrants served on us, or in connection with a legal investigation; or we have reason to believe that someone may be causing injury to someone or interfering with our rights or the rights of our users, or general public, or using our services in violation of a legal or personal right, including our Terms of Use.
      7. In connection with a sale, merger, transfer, exchange, or other disposition (whether of assets, stock, or otherwise, including via bankruptcy) of all or a portion of the business conducted by the Complex App to which this policy applies, in which case the company will possess the Personally Identifiable Information collected by us and will assume the rights and obligations regarding your Personally Identifiable Information as described in this Privacy Policy.
    2. Social Networks. If you access a social networking site (“Social Network”) such as Facebook or Twitter via the links we provide in the Complex App, you are leaving the Complex App and any activities you conduct on the Social Network will be governed by its terms of service and privacy policy. We may receive information about you from the Social Network in accordance with the terms and conditions of the Social Network and the controls you have set with the Social Network for its sharing of information.
  5. Your Choices
    1. California & Canadian Users: Your California Privacy Rights. California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternatively, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes, if the customer has exercised an option to opt-out of such information sharing. Canadian residents also have certain rights to know how their information may be shared with third parties who engage in direct marketing activities. We do not disclose Personally Identifiable Information gathered through the Complex App to third parties for direct marketing purposes. For more information, you may contact us at legal@complex.com.
    2. Exceptions. If you have opted-out as described above, and thereafter you elect to use a service or to communicate with us in a way that requires us to contact you or share your information with a third party (e.g., you enter into a contest or sweepstakes or use an ecommerce service after opting-out), then your previous opt-out preferences will not apply to such service or communication. The opt-outs described above apply to marketing-related communications only and we may continue to send you service-related communications, including notices about your subscription.
    • (f) Device Alerts and Push Notifications. The Complex App may provide you with alerts or push notifications and you can change your preferences regarding these alerts or notifications through your device settings.
  6. Security of Your Personally Identifiable Information. We use industry-standard security technologies and procedures to help protect your Personally Identifiable Information from unauthorized access, use, or disclosure. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Complex uses reasonable efforts to protect your Personally Identifiable Information, Complex cannot guarantee its absolute security.
  7. Kids And Parents. The Complex App is not intended for use by children, especially those under age 13. There are commercially available tools to help you limit your children’s exposure to online material.
  8. Non-U.S. Users. If you are located outside of the United States, please note that the information you provide to us will be transferred to and processed in the United States, where laws regarding processing of Personally Identifiable Information may be less stringent than the laws in your country. By using the Complex App, you consent to this transfer and processing. You also consent to the adjudication of any disputes arising in connection with the Complex App in the federal and state courts of, and in accordance with the laws of, the state of New York.
  9. Changes to This Privacy Policy. This privacy policy is subject to occasional revision, and if we make any material changes in the way we use your Personally Identifiable Information, we will post notice of the changes on our Complex App. Any changes to this privacy policy will be effective upon thirty (30) calendar days following our posting of notice of the changes on the Complex App. These changes will be effective immediately for new users of the Complex App. Continued use of the Complex App, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
